General provisions
These Terms of Use (the “Terms”) govern access to and use of the Exbustl web service.
Exbustl (the “Service”) is a web app for tasks, projects, planning, goals, ideas, notes, saved links, time tracking and personal productivity statistics.
The Service is owned and provided by Ukrainian sole proprietor Huziev V. (registered Ukrainian name: Гузєв Віктор Олексійович), referred to in these Terms as the “Service Administration”.
Users should review these Terms before creating an account or using the Service. Use of Exbustl is subject to these Terms. Anyone who does not agree should refrain from using the Service.
These Terms apply to both free and paid access. Subscription purchases are governed by a separate Public Offer.
Account and security
To access the app, users create an account with a valid email address and complete the required email verification.
Users must provide accurate information needed for their accounts and take reasonable care to protect their sign-in credentials.
Passwords, verification codes, two-factor authentication secrets and other access credentials must not be shared with third parties. The app offers two-factor authentication settings.
If unauthorized access is suspected, users should secure their account where possible and report the issue to the Service Administration.
Users may stop using Exbustl and initiate account deletion through the feature provided in the app.
Features and plans
Exbustl offers the free Personal plan and the paid Personal Pro plan. Personal is available without a mandatory trial or a subscription purchase. Pro offers additional features and higher limits.
Current plan features and limits — Pricing
Prices, subscription periods, purchase, renewal, cancellation and refunds are covered by the separate Public Offer.
When paid access ends, the available plan’s features and limits apply. Handling of records exceeding free-plan limits depends on the app’s actual mechanisms and the paid-access terms; this provision does not imply automatic deletion of those records.
A Personal Pro subscription is not required to keep a free Personal account.
Acceptable use
Users may use Exbustl features made available to them for personal and professional work.
When using the Service, users must not:
- break applicable law or infringe other people’s rights;
- attempt unauthorized access to another account, data or infrastructure;
- bypass authentication, security measures or access restrictions;
- distribute malicious code or deliberately disrupt the Service;
- use Exbustl to harm other users or its infrastructure.
Users determine what they enter in their notes, tasks, projects and other records and are responsible for using that material lawfully.
The Service Administration may take proportionate steps to stop violations, maintain security and protect availability.
User content and intellectual property
Users retain the rights they hold in text, notes, saved links and other materials they add to their workspace.
By adding material to Exbustl, users authorize its technical processing, storage, reproduction and synchronization to the extent needed to provide Service features. This does not transfer ownership or exclusive rights in user material to the Service Administration.
The Service Administration does not sell user material to third parties, use it for behavioral advertising or supply it to external AI developers for model training.
Software, design, branding and other protected elements of Exbustl belong to their respective rights holders. Using the app does not transfer rights to source code or other intellectual property.
Service availability and data preservation
The Service Administration takes reasonable steps to maintain Exbustl’s operation and security. Features may occasionally be unavailable due to maintenance, updates, faults or circumstances beyond its control.
Exbustl supports local storage of work records followed by server synchronization. Some features may be limited without an internet connection.
Changes not yet synchronized may be lost if browser data is cleared, local storage is damaged or a device fails. Users should export important records using the available features.
The Service Administration may improve the technical implementation and fix defects. Material changes affecting acquired rights or paid-access terms will comply with applicable law and contractual obligations.
Access restrictions and account deletion
The Service Administration may temporarily and proportionately restrict account access when there are indications of unauthorized use, material violations of these Terms or a security threat.
Where feasible and consistent with protecting the Service, the user will be informed of the reason for the restriction and how to request clarification.
Users can initiate account deletion in app settings. Deletion ends access to the associated workspace and removes data according to the Privacy Policy.
Recovery of permanently deleted data cannot be guaranteed. Export important information before deleting an account.
Financial obligations and user rights related to an active paid plan on an account being deleted are governed by the Public Offer and applicable law.
Responsibilities and liability
The Service Administration is responsible for supplying the Service according to these Terms, applicable law and obligations for purchased services. Users are responsible for complying with the Terms and for the legality of their conduct and content.
The Service Administration cannot guarantee uninterrupted operation of users’ internet connections, equipment or independent third-party services on which individual Exbustl features depend.
Nothing in these Terms excludes or limits the Service Administration’s liability where prohibited by law or removes users’ mandatory consumer rights.
Personal data and external websites
Personal data processing is covered by the Privacy Policy. Cookies and browser storage technologies are explained in the separate Cookie Policy.
Users can save links to third-party websites in Exbustl. The Service Administration does not control their content or independent actions and is not responsible for them except where the law requires otherwise. Third-party websites are governed by their own rules.
Changes to the Terms and contact details
The Service Administration may update these Terms when Exbustl features, legal requirements or the way services are provided change. The current version and update date will be published on the official website.
For material changes, the Service Administration will give any notice required by applicable law. Changes must not unlawfully deprive users of rights they have already acquired.
Ukrainian law applies to the parties’ relationship, subject to mandatory consumer protection provisions that may apply in the relevant jurisdiction.
The parties may try to resolve disputes through support. This does not limit the user’s right to contact a competent authority or court.
